Terms and Conditions

These Terms and Conditions govern your access to and use of Know Your Assignment.

Know Your Assignment is operated by Ruwach Global Enterprise Pty Ltd trading as Ruah Tech Solutions, ABN 73 147 792 774.

In these Terms:

• “KYA”, “Know Your Assignment”, “we”, “us” and “our” refer to Ruwach Global Enterprise Pty Ltd trading as Ruah Tech Solutions.
• “Platform” means the Know Your Assignment websites, mobile applications, assessments, software, digital resources, communications, community features and related services.
• “Content” means text, graphics, assessments, assignment profiles, archetypes, prayers, declarations, scriptures, resources, videos, audio, software and other materials made available through KYA.
• “User Content” means information or content that a user creates, submits, uploads, saves or shares through the Platform.
• “you” and “your” refer to a person accessing or using the Platform.

By accessing the Platform, creating an account, completing an assessment, purchasing a subscription or selecting an option indicating acceptance, you agree to these Terms and our Privacy Policy.

If you do not agree, you must not access or use the Platform.

If you use KYA on behalf of a church, ministry, company or other organisation, you represent that you have authority to bind that organisation to these Terms.

You must be at least 16 years old to create a standard KYA account.

If you are aged 16 or 17, you confirm that you have permission from your parent or legal guardian where required; your parent or guardian has reviewed these Terms where required; and you are legally permitted to use the Platform in your jurisdiction.

The Platform is not intended for children under 16 unless KYA introduces a specifically approved youth service with appropriate parental-consent and child-safety controls.

We may request information to confirm age, identity or authority.

KYA is a Christian spiritual-formation and purpose-discovery platform designed to help believers reflect on their God-given purpose; strengths and areas of growth; personality and communication style; potential assignment or sphere of impact; prayer life; spiritual formation; personal reflections; action steps; and progress over time.

The Platform may include assignment assessments; assignment and archetype profiles; personality insights; journal reflections; prayer prompts; declarations; personal notes; progress tracking; growth challenges; educational resources; community features; church or ministry programs; and other related tools.

Features may be added, changed, suspended or withdrawn over time.

KYA is a reflective and educational tool. It is not God, a church, a pastor, a prophet, a spiritual authority or a substitute for a personal relationship with God.

• is not a prophecy;
• is not a direct word from God;
• is not a guarantee of your calling, identity, ministry or future;
• does not confer spiritual authority;
• does not constitute ordination, commissioning or ministry accreditation;
• does not replace Scripture;
• does not replace prayer or personal discernment;
• does not replace wise pastoral or community counsel; and
• should not be treated as the sole basis for a major life decision.

You remain responsible for testing, considering and applying all Platform content with wisdom, prayer, Scripture, personal responsibility and appropriate counsel.

KYA does not guarantee that every church, denomination, pastor, theologian or Christian tradition will agree with every interpretation, archetype, prayer, declaration or resource presented on the Platform.

KYA does not provide medical advice; mental-health advice; psychological diagnosis; counselling or therapy; legal advice; financial advice; investment advice; employment advice; career certification; relationship counselling; crisis intervention; or other regulated professional services.

The Platform must not be used as a replacement for assistance from an appropriately qualified professional.

Assignment results must not be used by an employer, church, ministry or other organisation as the sole basis for making decisions about employment, promotion, dismissal, leadership eligibility, ministry appointment, ordination, safeguarding, medical care or another significant matter.

KYA is not an emergency-response or crisis-monitoring service.

Journal entries, prayer notes, messages and assessment answers are not continuously monitored.

If you or another person is in immediate danger or requires urgent medical, mental-health, pastoral or emergency assistance, contact the emergency services or an appropriate crisis service in your location.

Do not rely on KYA to identify, monitor or respond to an emergency.

Some Platform features require an account.

You agree to:

• provide accurate and current information;
• maintain only one account unless we authorise otherwise;
• keep your login credentials confidential;
• use a strong and secure password;
• promptly update material changes to your information;
• notify us of suspected unauthorised account access;
• take reasonable steps to secure your device; and
• accept responsibility for activity conducted through your account, except where caused by our breach of law or negligence.

You must not impersonate another person; create an account using false or misleading information; share an account in a manner not permitted by your plan; access another person’s account without permission; or sell, transfer or commercially exploit an account.

We may require you to verify your identity before providing account access or processing certain requests.

Assessment results and personalised content may be generated using your answers; scoring models; classification rules; algorithms; artificial intelligence; predefined content; user preferences; and other automated or semi-automated processes.

Assessment results involve generalisations and may not fully reflect your personality, history, maturity, gifting, circumstances or beliefs.

We do not guarantee that an assessment result is complete; a result will remain unchanged; the same result will be generated after the assessment is updated; a recommendation will be suitable for every user; a user will agree with an assignment classification; a particular outcome will result from following an action step; or personalised content will be free from error.

You may retake or review an assessment where the relevant feature permits.

Certain features may use artificial intelligence or automated content generation.

• contain errors;
• misunderstand context;
• omit relevant information;
• produce repetitive content;
• reflect limitations in underlying models or data; or
• generate content that requires discernment and human review.

You must not represent AI-generated or automated Platform content as a guaranteed revelation, prophecy, professional opinion or factual determination.

KYA may review, moderate, update or remove automated content where we consider it inaccurate, unsafe, inappropriate or inconsistent with the purpose of the Platform.

You retain ownership of the User Content you create or submit, subject to the permissions in these Terms.

User Content may include assessment responses; journals; prayers; personal notes; dreams; scriptures; testimonies; photographs; comments; messages; community posts; and other material submitted through the Platform.

You grant KYA a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, format, transmit and display your User Content only to the extent reasonably necessary to operate the Platform; provide features you request; synchronise content across devices; maintain backups; provide technical support; secure the Platform; comply with law; and carry out another purpose to which you have agreed.

This licence ends when the relevant content is deleted from active systems, subject to reasonable backup, legal, security and technical-retention requirements.

You are responsible for your User Content and must ensure that you have the necessary rights and permissions to submit it.

Private journals and personal notes are designed to be accessible through your account.

You acknowledge that authorised KYA personnel and contracted technology providers may access private content where reasonably necessary to resolve a technical-support request; restore or maintain the Platform; investigate suspected misuse; respond to a security incident; comply with law; protect a person from a serious threat; or enforce these Terms.

We will not routinely publish or share private journals and notes with churches, employers or other users.

You should not store passwords, payment-card details, government identifiers or other information that is not reasonably required for the Platform.

Where KYA provides groups, circles, comments, testimonies, discussion areas or other community functionality, content you submit may be visible to other group members; group leaders; church or organisational administrators; KYA moderators; or the public, depending on the feature.

Before submitting content, review the audience and privacy settings displayed by the relevant feature.

You must not post content that breaches another person’s privacy; reveals confidential pastoral information without permission; contains another person’s sensitive information without consent; is defamatory; is discriminatory or hateful; threatens, harasses or intimidates; exploits or endangers a child; encourages violence or unlawful conduct; contains sexual exploitation material; promotes fraud or deception; infringes intellectual-property rights; contains malware or harmful code; impersonates another person; constitutes unauthorised advertising or spam; or is otherwise unlawful or seriously inappropriate.

We may review, restrict, remove or preserve community content where reasonably necessary to operate and protect the Platform.

Churches, ministries and organisations may purchase, sponsor or administer access to KYA.

Where you participate through an organisation, the organisation may know that you have been invited or registered; the organisation may be able to see administrative information, such as enrolment or general completion status; any information shared with an organisation should be explained through the relevant feature or program; private journals and personal notes will not ordinarily be visible to the organisation; and your relationship with the organisation remains separate from your contractual relationship with KYA.

An organisation must not use KYA results as the sole basis for decisions concerning employment, ministry appointment, discipline, counselling, safeguarding or another significant matter.

Additional organisational terms may apply to church, ministry or enterprise subscriptions.

KYA may offer free and paid services.

Paid services may include recurring subscriptions; one-time purchases; premium assessments; digital resources; church or organisational plans; courses; events; and other premium features.

Before completing a purchase, you will be shown the applicable price, currency, billing period and material conditions.

Where you purchase a recurring subscription the subscription will renew at the stated interval unless cancelled; the applicable payment method may be charged automatically; the renewal price will be the price disclosed to you, subject to any properly notified price change; you are responsible for cancelling before the renewal date if you do not want the subscription to renew; and cancellation generally takes effect at the end of the current paid period unless applicable law or the marketplace provides otherwise.

Purchases made through Apple App Store, Google Play or another marketplace are also governed by that marketplace’s payment, cancellation and refund rules.

You may need to manage or cancel an application subscription through your Apple, Google or marketplace account.

We may change subscription prices by providing notice required by applicable law or marketplace rules.

A price change will not ordinarily affect a prepaid subscription period already purchased.

Prices may include or exclude GST or other taxes as indicated during purchase.

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or another applicable law.

Where the Australian Consumer Law applies, our services come with guarantees that cannot be excluded.

You may be entitled to a refund, cancellation, re-supply or another remedy where required by law.

Refund requests for purchases made through an application marketplace may need to be submitted directly to the marketplace, subject to your rights under applicable law.

A change of mind does not automatically create a right to a refund, except where required by law or expressly offered by us or the relevant marketplace.

You must not use the Platform to:

• break any law;
• harm, exploit or deceive another person;
• harass or threaten KYA personnel or users;
• gain unauthorised access to systems or accounts;
• bypass security or access controls;
• interfere with Platform operation;
• introduce viruses, malicious code or harmful technology;
• scrape, crawl or extract data without written permission;
• reverse engineer or attempt to obtain source code, except where the law expressly permits;
• create a competing assessment, database or service from KYA Content;
• copy or redistribute paid Content without permission;
• conduct unauthorised commercial activity;
• send spam;
• manipulate assessment systems;
• create false engagement or accounts;
• use automated bots without permission;
• misuse another person’s personal information;
• infringe intellectual-property rights;
• train a commercial AI model using KYA Content without written permission; or
• encourage another person to do any of these things.

Except for User Content and third-party material, all rights in the Platform and KYA Content are owned by or licensed to KYA.

This includes rights in the Know Your Assignment name and branding; logos; assessment questions; scoring systems; assignment frameworks; archetype names and descriptions; spheres of impact; reports; prayers; declarations; written resources; graphics; user-interface designs; videos and audio; software; databases; and Platform documentation.

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable licence to access and use the Platform for your own lawful, non-commercial purposes.

You must not reproduce, publish, distribute, sell, sublicense, modify, adapt or commercially exploit KYA Content without written permission.

You may quote brief extracts for personal ministry discussion or non-commercial reference where legally permitted and where KYA is appropriately acknowledged.

Scripture quotations, books, articles, videos, music and other third-party materials may be subject to third-party copyright and licence conditions.

Any relevant attribution or copyright notice must be retained.

The inclusion of third-party content or a link does not necessarily mean that KYA endorses every statement, belief, organisation, product or service associated with it.

If you voluntarily provide suggestions, ideas or feedback about KYA, you grant us permission to use that feedback without restriction or payment to improve, develop or promote the Platform.

This does not give us ownership of your private journals, personal prayer notes or other User Content.

Where permitted by law, we may send you information about KYA features; resources; events; subscriptions; church partnerships; new assessments; and related services.

You may unsubscribe from marketing communications at any time.

We may continue sending essential account, security, transaction and service communications.

The Platform may integrate with or link to Apple; Google; payment providers; social networks; authentication services; churches; ministries; content providers; and other third-party services.

Third-party services are governed by their own terms and privacy practices.

We do not control and are not responsible for third-party services, except to the extent responsibility cannot lawfully be excluded.

We aim to provide a reliable Platform but do not guarantee uninterrupted or error-free access.

The Platform may be unavailable because of maintenance; upgrades; security incidents; internet or cloud-provider failures; application marketplace issues; device incompatibility; events outside our reasonable control; or suspension of a feature.

We may change, update, discontinue or replace a feature where reasonably necessary.

Where a change materially affects a paid service, we will comply with applicable consumer law and marketplace requirements.

You may need to install updates to continue using the Platform securely.

Older versions may stop functioning or may not support all features.

You are responsible for maintaining a compatible device, internet connection and operating system.

We may restrict, suspend or terminate access where we reasonably believe you have materially breached these Terms; your account presents a security risk; you have used the Platform unlawfully; you have harmed or threatened another person; payment is overdue; suspension is required by law; continued access may damage the Platform; or the service is being discontinued.

Where appropriate, we will provide notice and an opportunity to address the issue.

We may act immediately where necessary to protect users, children, the public, KYA or Platform security.

You may stop using KYA at any time.

You may request account deletion through any available account-deletion feature or by contacting kya@ruahtech.com.au.

Deleting your account does not automatically cancel an Apple, Google or marketplace subscription; remove public content copied or shared by others; remove information we must retain by law; or remove de-identified information.

You should separately cancel any recurring subscription through the provider that manages the billing.

To the maximum extent permitted by law the Platform is provided on an “as available” basis; we do not guarantee that every feature will always be available; we do not guarantee a specific spiritual, personal, professional or financial outcome; we do not guarantee that assessment results are complete or error-free; we do not guarantee that Platform content will suit every theological tradition; we do not guarantee that use of KYA will resolve uncertainty, distress, relational issues or career decisions; and you remain responsible for decisions made using Platform information.

Nothing in this section excludes rights that cannot lawfully be excluded.

To the maximum extent permitted by law, KYA and Ruah Tech Solutions will not be liable for indirect, incidental, special or consequential loss arising from your use of the Platform, including loss arising from reliance on an assignment result; a personal, spiritual, ministry, career or business decision; loss of opportunity; loss of data not caused by our failure to take reasonable care; unauthorised account access caused by your failure to secure your credentials; conduct of another user; third-party services; or events outside our reasonable control.

Where liability cannot be excluded but can lawfully be limited, our liability may be limited, at our option, to supplying the relevant service again; or paying the reasonable cost of having the service supplied again.

This limitation does not apply where it would be unlawful, including where loss results from fraud, wilful misconduct, gross negligence or a breach of a non-excludable consumer guarantee.

To the extent permitted by law, you are responsible for reasonably foreseeable loss suffered by KYA resulting from your unlawful use of the Platform; your material breach of these Terms; User Content that infringes another person’s rights; or your intentional misuse of Platform systems.

This section does not make you responsible for loss caused by KYA’s negligence, unlawful conduct or breach of these Terms.

Our Privacy Policy explains how we collect and handle personal information.

By using the Platform, you acknowledge that you have reviewed the Privacy Policy.

If you have a concern, please contact us first at kya@ruahtech.com.au.

Please include your name; the email associated with your account; a description of the issue; the outcome you are seeking; and relevant supporting information.

We will attempt to resolve the matter in good faith.

Nothing in this section prevents either party from seeking urgent legal relief or exercising rights under consumer law.

These Terms are governed by the laws of South Australia and the Commonwealth of Australia.

Subject to any rights you have under applicable consumer law, the parties submit to the jurisdiction of the courts of South Australia and courts entitled to hear appeals from those courts.

If you are a consumer in another jurisdiction, you may also have mandatory rights under the laws of that jurisdiction.

We may update these Terms to reflect changes to the Platform; new features; changes to payment arrangements; changes to law; security requirements; or operational changes.

The updated Terms will be published with a revised effective date.

For material changes, we may provide notice through the Platform, by email or through another appropriate method.

Where required by law, we will request your agreement to updated Terms.

34.1 Entire agreement. These Terms, together with the Privacy Policy and any applicable purchase or organisational terms, form the agreement between you and KYA concerning the Platform.

34.2 Severability. If a provision is found invalid or unenforceable, the remaining provisions will continue to apply.

34.3 No waiver. A failure to enforce a provision does not waive the right to enforce it later.

34.4 Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer these Terms as part of a genuine restructure, merger, sale or transfer of the Platform, subject to applicable law.

34.5 No partnership. These Terms do not create an employment, partnership, joint venture, agency, pastoral or fiduciary relationship between you and KYA.

34.6 Interpretation. Headings are for convenience and do not limit interpretation. Words such as “including” are not words of limitation.
